2. Collection and storage of personal data and nature and purpose of its use


a) When visiting the website

When accessing our website, information is automatically sent to our website’s server by the browser being used on your terminal. This information is temporarily stored in a so-called log file. The following information is captured without your assistance and stored until the time of automatic deletion:

  • Name of the accessed file
  • Date and time of access
  • Volume of data transmitted
  • Report on whether the access was successful
  • Type of web browser used
  • Type of operating system used
  • Previously visited webpage
  • Name of your Internet provider
  • Your IP-address

The data mentioned above is processed by us for the following purposes:

  • To guarantee a smooth connection set-up for the website,
  • To guarantee convenient use of our website,
  • To evaluate the security and stability of the system, as well as
  • For further administrative purposes.

The legal basis for the data processing is Article 6 paragraph 1(f) of the GDPR. Our legitimate interest is derived from the above-listed purposes of data collection. On no account will we use the collected data for purposes of tracing your identity.

Furthermore, we use cookies for any visit to our website. Detailed explanations on this are set forth in sections 4 and 5 of this privacy policy.

b) When using our contact form

In case of inquiries of any nature, you can contact us through a form provided on the web site. Submitting a valid e-mail address is required to allow us to know who has sent the inquiry and to allow us to answer it. Any other details can be provided voluntarily.

We process your data for purposes of establishing contact with us in accordance with Article 6 paragraph 1(a) of the GDPR, based on the consent you voluntarily gave us.

The personal data collected by us during your use of the contact form will automatically be deleted after your inquiry has been handled.

3. Sharing of data

Your personal data will not be transmitted to third parties for purposes other than those listed below.

We will share your personal data with third parties only if

  • You have given your express consent to that effect in accordance with Article 6 paragraph 1(a) of the GDPR, for instance to courier-service providers by agreeing to separate participating conditions for certain competitions,
  • the sharing is required under Article 6 paragraph 1(f) of the GDPR, and if there is no reason to assume that you have an overriding legitimate interest in your data not being shared,
  • there is a legal obligation under Article 6 paragraph 1(c) of the GDPR to share your data, and
  • if this is legally permitted and required in accordance with Article 6 paragraph 1(b) of the GDPR, for purposes of processing some contractual relationships with you.

4. Cookies

We use so-called Cookies in certain sections of our website. Such data elements allow your computer to be identified as a technical unit during your visit to this website, to make your use of our online content easier – and also during repeat visits.

These cookies are used to identify your anonymised client computer and store information regarding whether you have noted the reference to the use of cookies.
No personal data is stored or transmitted.

We base our use of the aforementioned analysis tools on Art. 6(1)(a) of the GDPR: the processing is carried out based on your voluntarily given consent.

5. Use of Google Analytics

We use Google Analytics, a web analysis service of Google Ireland Limited , („Google“) with registered office at Gordon House, Barrow Street, Dublin 4, Ireland.  

Google Analytics uses so-called “Cookies”. These are text files that are stored on your computer and that enable us to analyse your use of the website. Information generated by cookies about your use of this website (including your IP-address) is generally transmitted to a server belonging to Google in the USA and stored there.

We would like to point out that on this website Google Analytics was extended by the code “gat._anonymizeIp();” in order to ensure anonymised transmission of IP-addresses (so-called IP-masking). Since IP anonymisation is activated on this website, your IP-address is nonetheless first truncated by Google within the member states of the European Union or in other states which are party to the Agreement of the European Economic Area. Only in exceptional cases is the full IP-address transmitted to Google’s server in the USA and truncated there.

Google will use this information on our behalf to evaluate your use of the website, to compile reports about the website activities, and to render to us further services connected with the website and Internet usage. The IP-address transmitted by your browser in connection with Google Analytics will not be merged with other data by Google.

6. Use of other Google services (Google Maps, Google Fonts)

We use “Google Maps” on our websites to present maps and the web-font service “Google Fonts” to present scripts on the web. Both are services of Google Ireland Limited, („Google“) with registered office at Gordon House, Barrow Street, Dublin 4, Ireland, in this process, some data can be transmitted to the provider. 7. Use of YouTube in extended data protection mode

We use the provider YouTube to embed videos. The videos are embedded in extended data protection mode. However, like most websites, YouTube also uses cookies to collect information about visitors to its website. YouTube uses these to collect video statistics, prevent fraud and improve user-friendliness, among other things. This also leads to a connection being established with the Google DoubleClick network. When you start the video, this could trigger further data processing operations. We have no influence on this. 8. Integration of X (formerly Twitter)

Content and associated functions of Twitter can be used on our website and, for example, displayed as a feed; the provider in this case is X Corp, 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. As part of this use, content such as images, videos and texts as well as buttons for liking and subscribing to Twitter can be loaded. If you use these functions and have an account on the Twitter platform itself, Twitter can assign your activities to your profile via your account. a. Right to information

You have the right to demand confirmation from us as to whether your personal data is being processed.

b. Right to rectification/erasure/restriction of processing

Furthermore, you also have the right to demand of us that

  • Incorrect personal data concerning you be corrected immediately (Right to rectification);
  • Personal data concerning you be deleted immediately (Right to erasure), and
  • that the processing of your personal data be limited (Right to restriction of processing).

c. Right to data portability

You have the right to get personal data concerning you – and which you provided to us – in a structured, conventional and machine-readable format and to transmit this data to another person responsible.

d. Right of revocation

You have the right to revoke your consent at any time. By revoking the consent, the legitimacy of the processing that was carried out based on that consent up to the time of revocation will not be affected.

General data protection declaration for business partners (status 01/08/2022)

1. Introduction and general provisions 

Protecting your personal rights when processing personal data is a priority for the DMK Group companies (hereinafter “we” or “us”). We process personal data in accordance with the requirements of the European General Data Protection Regulation (GDPR) and other relevant laws.

The purpose of this document is to inform you about the processing of your personal data within the scope of existing or prospective business relations and give you an overview of your rights under the data protection laws and regulations.

2. Controller and contact person

3. Data categories and data origin 

We process the following data categories that we have obtained or collected from you. 

  • Personal master data (e.g., name, address) 
  • Communication data (e.g., telephone, e-mail, fax) 
  • Contract, billing and payment data 
  • Business history data 

and any other information required to initiate or conduct the business relationship. 

Within the framework of our business relationship, you are obliged to provide us with the personal data needed to initiate and implement a business relationship as well as fulfil the associated contractual obligations or which we are legally obliged to collect. If you do not provide us with said data, we cannot fulfil our contractual and legal obligations. 

We also process personal data obtained from public directories (for example, commercial registers) in compliance with data protection requirements, or that we have received from reliable third parties (for example, courts, authorities, insurance companies, credit agencies).

4. The purpose of processing and legal basis 

a) General data processing within the scope of the business relationship 

We process your personal data in compliance with the provisions of the EU General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) as well as all other relevant laws and regulations. 

The data processing takes place 

  • to fulfil a contract or to implement pre-contractual measures (Article 6 (1) (b) GDPR) 
  • to fulfil a legal obligation to which the controller is subject (Article 6 (1) (c) GDPR) 
  • to pursue the following legitimate interests of the controller (Article 6 (1) (f) GDPR), provided that our interests are not overridden by your interests or fundamental rights and freedom

    - for the establishment and defence of legal claims
    - for the prevention of criminal offences
    - for measures to optimise the internal processes relevant to the business relationship, e.g. maintaining “customer relationship” databases
    - for reduction of default risks through consultation with credit agencies
    - for measures to ensure the security of buildings and facilities as well as the protection of property rights (e.g. access controls)
    - for the implementation of prequalification measures. For more information see point 4b)  
     
  • on the basis of your consent (Article 6 (1) (a) GDPR). You may withdraw your consent with future effect at any time by contacting the controller at the above-mentioned address. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

b) Data processing within the framework of prequalification procedures 

Under certain circumstances we carry out prequalification procedures when establishing contractual relationships. Their purpose is to ensure the fulfilment of the applicable requirements of the German Foreign Trade Act, the German Money Laundering Act and the integrity of the business partner, its bodies and/or beneficial owners.

We process this data on the basis of our legitimate interest (Article 6 (1) (f) GDPR) as well as to fulfil legal obligations (Article 6 (1) (c) GDPR). For this purpose we also obtain information from third parties. 

5. Recipients 

In our company, the above-mentioned categories of person data will only be disclosed to persons or offices that require this information to fulfil the specified processing purposes. 

In addition, we may transfer your personal data to other recipients outside the company where this is necessary for us to meet our contractual and statutory obligations (such as authorities, supporting service providers, insurance companies, credit agencies). The data will not be transferred to third countries. 

6. Rights of data subjects 

You have the right to request information on the data stored in relation to your person using the above address. You are also entitled to request the rectification or erasure of your data under certain conditions. You also have the right to restrict the processing of your data and the right to receive the data you have provided to us in a structured, commonly used and machine-readable format.

Right to object 

Where we process your data to safeguard our legitimate interests, you can object to this processing on grounds relating to your particular situation. We shall no longer process your personal data, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or the establishment, exercise or defence of legal claims.

7. Right to lodge a complaint 

You can either lodge a complaint with the data protection officer specified above or the competent supervisory authority.

8. Duration of storage 

We store your personal data as long as necessary to fulfil our legal and contractual obligations.

If it is no longer necessary to store said data to fulfil contractual or legal obligations, it will be deleted unless it is necessary to continue processing it for the following purposes:  

  • Fulfilment of commercial and tax law storage obligations
  • Preservation of evidence within the framework of the legal statute of limitations.
